What is FMLA?

The Family and Medical Leave Act is federal legislation passed in 1993 to help balance workplace requirements with the needs of a family.


What does FMLA provide?

It provides you with up to 12 weeks of leave for certain family and medical reasons during a 12-month period. It guarantees re-instatement to the same job held prior to the leave or an equivalent position with equivalent pay, benefits, and other terms of employment. You also receive continuation in group health coverage under the same conditions as active employees.


Who is covered under FMLA?

  • Staff (including Bargaining unit employees)


  • Post Doctoral Scholars


  • Post Doctoral Associates


  • Research Associates



When am I eligible for FMLA?

Once you have worked a minimum of 12 months for the University and worked at least 1250 hours in the 12 months immediately preceding the leave start date.


What are qualifying events under FMLA?

  • Birth of a child and care of a newborn child


  • Care of a child placed with you for adoption or foster care


  • Care of your spouse/registered domestic partner, child, or parent who has a serious health condition


  • Your serious health condition that prevents you from doing the essential functions of your job


  • The following definitions are used for “family member”

    • “Family member” includes spouse and, under University policy a registered domestic partner, child or parent.


    • “Spouse” includes husband, wife and, under University policy, a registered domestic partner.


    • “Child” means biological, adopted or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis. The child must be under 18 years of age unless s/he is incapable of self-care due to disability.


    • “Parent” includes a biological, foster, or adoptive parent, a stepparent or a legal guardian. “Parent” does not include in-laws.




When should I file for FMLA?

When you have been absent for work for more than three consecutive work days or if you have a foreseeable need for leave within 30 days.


How do I file for FMLA?

You should call MetLife at 1-888-777-7418.


Will I get paid during FMLA?

For staff employees, the University requires you to use accumulated sick days concurrently with an approved FMLA leave. Accrued sick days (up to a maximum of 60 sick days) must be exhausted before other accumulated time (vacation or personal days) may be used to extend salary continuation during an approved FMLA leave. A research associate on a 12-month contract receives 20 vacation days per year. These "days" can be used as payment during a FMLA leave. A Post Doctoral Associate/Post Doctoral Scholar on a 12-month contract receives 20 compensated days annually that can be used for vacation, personal days, brief sick day periods, and University-wide holidays and the Holidays recess.

You should call the benefits department at 412-624-8059.


Note: MetLife will not administer the Faculty Medical Family Leave (FMFL) for Eligible Faculty. The Office of the Provost will continue to administer the policy and can be reached for questions at 412-624-4222.
